1. Acceptance of Terms
By accessing or using PolicyFlowAI ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. Description of Service
PolicyFlowAI is a marketing and productivity platform designed for licensed insurance professionals. It provides AI-generated content drafts, lead capture tools, exam study resources, and agent page builder functionality.
3. Eligibility
You must be at least 18 years old and a licensed insurance professional (or actively studying for licensure) to use this Platform. By using the Platform, you represent and warrant that you meet these requirements.
4. Subscription and Billing
The Platform is offered on a subscription basis. All subscriptions begin with a 7-day free trial. If you do not cancel before the trial ends, your payment method will be charged the applicable monthly rate. You may cancel at any time from your account dashboard.
5. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
6. Acceptable Use
You agree not to use the Platform to:
- Violate any applicable law or regulation, including insurance advertising laws
- Publish false or misleading insurance claims
- Impersonate another person or entity
- Distribute spam or unsolicited communications
- Attempt to reverse-engineer or copy the Platform
7. AI-Generated Content — Compliance Liability
Important: Insurance Agent Compliance Responsibility
PolicyFlowAI is a marketing tool that generates draft content for licensed insurance professionals. All outputs are drafts only. The user is solely responsible for reviewing every output for compliance with their state's insurance advertising rules, federal regulations (including CMS Medicare Marketing Guidelines where applicable), and any carrier-specific marketing requirements.
PolicyFlowAI does not pre-approve, vet, or guarantee compliance of any generated content. The Platform makes no representations that AI-generated content satisfies any regulatory requirement. By using the Platform, you accept full liability for content you publish.
If you sell Medicare products, you are solely responsible for ensuring all content meets CMS Medicare Marketing Guidelines (Chapter 3 of the Medicare Managed Care Manual and Chapter 4 of the Prescription Drug Benefit Manual) before publication.
If you are licensed in California, you are solely responsible for ensuring all advertising complies with Cal. Ins. Code §1725.5 and any applicable DOI guidance.
8. Intellectual Property
Content you generate using the Platform remains your property. The Platform's underlying technology, design, and proprietary systems remain the property of PolicyFlowAI. You grant us a limited license to process your inputs to deliver the service.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of information as described therein.
10. Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or compliant with any law or regulation.
11. Limitation of Liability
To the maximum extent permitted by law, PolicyFlowAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of revenue, data, or business opportunities, arising from your use of the Platform.
12. Indemnification
You agree to indemnify and hold harmless PolicyFlowAI and its officers, directors, employees, and agents from any claims, damages, or expenses (including attorneys' fees) arising out of your use of the Platform, your violation of these Terms, or your violation of any applicable law or third-party rights — including any claim arising from content you publish based on AI-generated drafts from the Platform.
13. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
